No. While we strongly urge everyone who purchases property to buy Owners' Title Insurance, that policy may only cover you for defects that were undisclosed or that existed prior to the date of your purchase. National Homestead will assist you in removing "title defects" that have occurred since the date of your purchase.
Since 1999, more than 450 Million documents have been recorded at County Recorder offices throughout the U.S. This avalanche of paper has created hundreds of thousands of "title defects." These typically consist of unrecorded mortgage discharges, incorrectly recorded discharges, missing mortgage assignments, or missing deeds. These "title defects" are waiting to explode when you least expect it and can least afford the expense, delay and aggravation.
As a result of the recent mortgage refinance craze and record home sales, the entire loan and recording process has broken down, putting your title in ruins and your ability to sell in jeopardy. The lenders and County Recorders are unable to accurately produce and record all of the documents necessary to ensure that your property remains free and clear.
While exact numbers are difficult to obtain given the hundreds of millions of titles that exist in the United States, independent surveys have indicated that upwards of 45% percent of all titles are stricken with "Title Defects" that are waiting to explode at the worst possible time.
The most common defect (and potentially the most devastating) involves a missing mortgage discharge. For example: You think that you have only one (1) mortgage on your property, but your title records show two (2). This is because when you refinanced, the discharge for your old mortgage was either never issued or never released. You will be unable to sell your home or refinance your loan until these documents get recorded and there is proof that the old loan has been paid off.
Other examples of Title Defects are missing mortgage assignments (where one lender sells the loan to another lender but fails to record the proper paperwork and mortgages obtained thru Mortgage Fraud.
